Advance Parole is a document that allows certain aliens to re-enter the United. Rather still under H-1B status, and his/her I-485 (AOS) application is preserved.

The EAD renewal form is a one-page document that requests a variety of identifying information. If you complete the document on a computer, you can type your answers directly into the fillable form and then print it out or save it as a PDF document. If you complete a paper copy of the form, be sure to print legibly and use a pen with black ink.
  • You must answer all of the questions, even if your response if “none” or “N/A” for not applicable.
  • Make sure you mark the box that specifies that you are applying for a renewal of your EAD.
  • Questions 1 through 8 request basic identifying information, such as your name and mailing address
  • Question 9 asks you to identify all of the social security numbers that you previously used, even if that number did not belong to you.
  • For question 10, if you do not have Alien Registration Number (A-Number) use your I-94 number. If you are unsure whether you have A-1 number, check all correspondence and paperwork that you may have received from the U.S. Immigration Agency. This may contain your A-Number.
  • For question 11, enter the address from the office that previously received your EAD application. The address is listed on the notice (Form I-797) you received from USCIS when you submitted your previous EAD application.
  • For questions 12 through 13, your entry location if you arrived by plane, is the city where your plane landed and where you were inspected by a U.S. border official. Similarly, if you crossed the border by plane or on foot, you will list the area where you were inspected by a U.S. border official.
  • For questions 14 through 15, provide either your visa category, i.e. student or visitor, or if you did not enter legally, you should write “no legal status.”
  • Question 16 requires you to enter a specific alphanumeric code that is associated with you eligibility status. You must read through the form’s instructions and identify your specific category.
  • Be sure to sign and date the form.[4]

Advance parole is an immigration document (Form I-512) issued by the United States Citizenship and Immigration Services (USCIS) to enable an alien to be paroled into the United States. It is not a U.S. visa or a re-entry permit; it is only issued to people without permanent residency. Advance parole is a permit for a non-U.S. national, who does not have a valid immigrant visa, to re-enter the United States after traveling abroad. Such persons include those who have applied to adjust their status to that of permanent resident or to change their non-immigrant status. Advance parole must be approved before the applicant leaves the United States, or any residency application be denied unless exceptional circumstances are demonstrated by the alien.[1]

Who needs advance parole?[edit]

Aliens in the United States need an advance parole if they have:

  • an application for adjustment of status pending.
  • been admitted as a refugee or have been granted asylum.
  • been granted benefits under the Family Unity Program.
  • been granted Temporary Protected Status (TPS).
  • an asylum application pending.
  • an emergent personal or bona fide reason to travel temporarily abroad.

Note: Aliens holding valid K-3 or K-4 visas, as well as H-1 (temporary worker in a specialty occupation) or L-1 (intra-company transferee) visas and their dependents in H-4 or L-2 status who have filed for adjustment of status do not have to file for advance parole as long as they maintain their non-immigrant status.[2]

Aliens in the United States are not eligible for an advance parole if they are:

  • in the United States without a valid immigration status.
  • an exchange alien subject to the foreign residence requirement.
  • the beneficiary of a private bill.
  • in removal proceedings.

/eminem-not-afraid-free-download.html. To obtain an advance parole, an applicant must file Form I-131 ('Application for Travel Document'), with supporting documentation, photos, and fee, at a local USCIS office or the service center having jurisdiction over their place of residence.

The document[edit]

Advance parole can come on a letter-sized piece of paper titled 'Authorization for Parole'. For applicants who apply for advance parole together with an employment authorization document (EAD), USCIS issues a 'combo card', a variant of the EAD card which contains the words 'SERVES AS I-512 ADVANCE PAROLE'.

Re-entry into the United States[edit]

Advance parole does not guarantee admission into the United States. Aliens who have obtained advance parole are still subject to the inspection process of the U.S. Customs and Border Protection at the port of entry. However, aliens who would otherwise be automatically inadmissible due to a period of unlawful presence, will not be inadmissible if they have advance parole.[3]
